Many software and platform businesses assume a DPO is only for public bodies and healthcare. But tracking users' behaviour online, profiling them for personalisation or advertising, and doing so at scale is exactly the kind of regular and systematic monitoring that triggers a mandatory DPO.
We act as the outsourced DPO for technology businesses across Bristol and the South West, remotely and on a fixed monthly fee.
Tracking, profiling and the DPO trigger
Behavioural advertising, analytics products, location tracking and fitness or wellbeing apps are the classic examples. If monitoring people's behaviour is central to what your product does, and you do it at scale, you are likely to need a DPO — as a controller or as a processor for your clients.
Be careful with the title
Startups often give someone the title “DPO” to reassure customers. If you do, that person has to meet all the statutory requirements: independence, reporting to the highest level of management, adequate resources and no conflicts of interest. A CTO or head of product with the DPO title usually fails the conflict test.
If you don't need a DPO and don't want the formal obligations, use a different title, such as privacy lead. If you do need one, an outsourced DPO avoids the conflict entirely.
Selling into the EU
Bristol businesses with EU customers but no EU establishment may also need an EU representative under the EU GDPR. That's a separate role from a DPO, and we can explain which applies. For a broader comparison of options, see outsourced vs in-house DPO.

DPO consultancy without an appointment
Not every organisation needs a formal DPO. If the mandatory triggers don't apply to you, our DPO consultancy gives you the same expertise on the specific areas you need — a compliance gap analysis, DPIAs for new projects, policy reviews, breach response support or staff training — without the statutory obligations that come with appointing a DPO.
For Bristol technology businesses it's typically a tracking and profiling review, a DPIA for a new product feature, or privacy-by-design input before launch.

Does our app need a DPO?
If your core activity involves regular and systematic monitoring of users at scale — behavioural tracking, profiling or location monitoring — it's likely. Scale and purpose are what decide it.
Can our CTO be the DPO?
Usually not. A CTO decides how systems process personal data, which conflicts with the DPO's independent monitoring role.
What if we call someone a privacy lead instead?
That's fine where a DPO isn't mandatory. The DPO title carries statutory obligations, so only use it where the role genuinely meets them.
