Care providers process health and social care data about the people they support every day. Whether that makes a DPO mandatory depends on whether the processing is large-scale and part of their core activities — which for a care provider it clearly is. The open question is scale.

We act as the named DPO for councils, care providers, academy trusts and employers across the region, remotely and on a fixed monthly fee.

Care providers and large-scale processing

Regulators have indicated that processing patient data by an individual professional isn't large-scale, while processing by a hospital is. Most care providers sit between those two points. A single small home is unlikely to meet the threshold; a group operating several homes or a large domiciliary care service processing data about many hundreds of people is much more likely to.

Because the line isn't a fixed number, the decision and the reasoning behind it should be documented. If you conclude a DPO isn't mandatory, recording why is itself part of demonstrating accountability.

Academy trusts and schools

Every state school, including academies, is a public authority and must have a DPO. Multi-academy trusts usually appoint one DPO across all their schools, which the law allows. Headteachers and school business managers generally shouldn't take the role, because they make the decisions the DPO is meant to monitor.

Manufacturing and private employers

Most West Midlands manufacturers and logistics firms don't meet the mandatory triggers — employee data and ordinary customer data aren't enough on their own. If you choose to appoint a DPO voluntarily, the same independence and resourcing rules apply as if it were mandatory, so many prefer an outsourced DPO to naming an internal manager.

How our outsourced DPO service works

  1. A free 30-minute consultation to understand your organisation, your processing and whether a DPO is mandatory for you.
  2. A clear proposal with a single fixed monthly fee, based on your size and complexity. No hidden costs.
  3. Your named DPO in place within 48 hours, with the ICO notified of their contact details.
  4. Ongoing support: monthly reporting, policy oversight, breach readiness and direct access to your DPO.

Every engagement runs on rolling monthly terms, with no long-term contract.

DPO consultancy without an appointment

Not every organisation needs a formal DPO. If the mandatory triggers don't apply to you, our DPO consultancy gives you the same expertise on the specific areas you need — a compliance gap analysis, DPIAs for new projects, policy reviews, breach response support or staff training — without the statutory obligations that come with appointing a DPO.

West Midlands care providers often start here: a documented assessment of whether their processing is large-scale, followed by policies and training sized to their homes.

Frequently asked questions

Does a care home need a DPO?

It depends on scale. A single small home is unlikely to be processing health data on a large scale; a group of homes or a large domiciliary service usually is. Document your reasoning either way.

Can our headteacher be the school's DPO?

Generally no. The headteacher determines how pupil and staff data is used, which conflicts with the DPO's independent monitoring role.

If we appoint a DPO voluntarily, do the same rules apply?

Yes. A voluntarily appointed DPO must meet the same independence, reporting and resourcing requirements as a mandatory one.
