Northern Ireland's eleven councils, its Health and Social Care Trusts and its other public bodies are public authorities, so each must appoint a DPO. For private businesses, the more common question is how cross-border trade affects their obligations.
We provide outsourced DPOs to organisations across Northern Ireland, remotely and on a fixed monthly fee. The ICO's Northern Ireland office is based in Belfast.
Groups with an Irish entity
Where a group has a company in the Republic of Ireland, that entity is subject to EU GDPR and regulated by the Data Protection Commission. If it meets the DPO triggers, it needs a DPO under EU law, and the DPO's contact details must be notified to the Commission.
A single DPO can cover both the Northern Ireland and Irish entities, provided they are easily accessible from each and understand both regimes.
Selling into the Republic
A Northern Ireland business with no establishment in the EU that offers goods or services to people in the Republic may need an EU representative under Article 27 of the EU GDPR. That's a separate role from a DPO, and appointing one doesn't satisfy the other.
HSC Trusts and councils
Health and social care in Northern Ireland is delivered together through Health and Social Care Trusts, so their DPOs deal with clinical and social work records side by side. Resourcing and independence are the usual challenges in organisations of that size. See what a DPO actually does.

DPO consultancy without an appointment
Not every organisation needs a formal DPO. If the mandatory triggers don't apply to you, our DPO consultancy gives you the same expertise on the specific areas you need — a compliance gap analysis, DPIAs for new projects, policy reviews, breach response support or staff training — without the statutory obligations that come with appointing a DPO.
Northern Ireland businesses often come to us for a cross-border review: which entity is the controller, whether an EU representative is needed, and whether a DPO is.

Does UK GDPR apply in Northern Ireland?
Yes. UK GDPR and the Data Protection Act 2018 apply across Northern Ireland, and the ICO regulates through its Belfast office.
Our Irish subsidiary needs a DPO — can ours cover it?
Yes, if the DPO is easily accessible from each establishment and competent in both UK and EU requirements. The Irish entity must notify the Data Protection Commission of the DPO's details.
Do we need an EU representative?
If you have no establishment in the EU but offer goods or services to people there, you may. It's a separate obligation from appointing a DPO.
